K.B. Sewall draft of letter to Phineas Barnes, Mobile, 1858

Description

Kiah B. Sewall, a native of Maine and 1829 graduate of Bowdoin College who was a lawyer in Mobile, Alabama, wrote to his college classmate and fellow lawyer Phineas Barnes in Portland, seeking his thoughts about a case in which Sewall was involved.

Before John A. Campbell of Alabama was named to the U.S. Supreme Court in 1853, Sewall had filed a bill to set aside a deed that was attained by fraud. Campbell was a witness for the defendants. When the case went to the U.S. Circuit Court, Sewall said, Campbell was involved in the defense and ruled on the case. Among his rulings, he fined Sewall $1,000 and revoked his license to practice before the Circuit Court, charging Sewall with contempt of court.

Sewall paid the fine under protest and sought Barnes' opinion on the legalities of the case, which was on appeal at the U.S. Supreme Court.

The letter is a draft of the one Sewall sent to Barnes.
